These are the terms and conditions (the “Terms” on the basis of which www.indiasfuture.com is made available to you (“Users”/ “Members”/ “Advertisers”) By accessing this website You agree to be bound by these Terms.
We request you to read these Terms carefully before accepting them. It is advisable to print these Terms and store them for future reference. We do not file our contract with you and your participation in this website along with your clicking “I Agree” will be considered as your acceptance to be bound by these Terms. Acceptance of these terms also implies that you have read and agree with our Privacy Policy.
If these Terms are translated into another language the English language version will prevail in the event of any conflict between the translation and the English language version.

How Indiasfuture Works

The Website provides chance-based contest which allow its qualifying users potentially to win a cash sum simply by registering with the Website and clicking on Advertisements from the ads hosted on the Indiasfuture Grid of the Website ("Indiasfuture").
The Indiasfuture Grid contains one million pixels. Advertisers have the option to purchase Pixels on the Indiasfuture Grid and apply images of their choice or from the images available and link their websites to form visual advertisements ("Ads").
Contests will begin after the first 20000 pixels have been sold. All ads and contests will be available for 1 years minimum, calculated from the date of launch of the website.
The first round of Indiasfuture will commence on January 20, 2007. Each subsequent round of Indiasfuture will commence on the round commencement date ("Round Commencement Date").
Each round will begin on the Round Commencement Date and conclude one calendar month ("Month") following the earlier of:
the date on which the Prize Fund (as defined below) reaches one million US dollars (USD$500,000); or Rs. 2.25 Crore .
No entry fee is required in order to participate in Indiasfuture. Participation is FREE for any one. We will select a winning qualifying user once in each Round at the end of such Round.
There is no entry fee required to participate in Indiasfuture.
The Indiasfuture prize fund for the entire duration of the Indiasfuture Grid will comprise of fifty percent (50%) of the Revenue Indiasfuture receives in exchange for Ads which are to be placed on the Indiasfuture Board.
There is going to be only 1 Mega winner who will get $ 450,000 & 50 other winners who will be next to Mega Winner they each will get $1000 or Rs. 45000/- into total price fund of $500,000 for each contest, along with the advertiser whose link was clicked. In the occasion that the winner is not eligible for the contest for any reason specified in these Terms the next user who clicked on one of the winning advertisement will be selected.
A day when all the pixels will be sold or on the 12 anniversary of Indiasfuture Grid here winners will be announced.
If there is only one candidate for the relevant round then, if a qualifying user, they will be the winner of the prize fund and where there is more than one candidate, one of the candidates will be selected by Us to be the winner of the Prize Fund.

When You Win Contests

If You are selected as the Winner We will contact You, using the details You provide upon Registration as soon as reasonably possible to ascertain that you are a qualifying user and to discuss arrangements by which to the allocated funds for the contest will be transferred You.
In the unlikely event that We are unable to contact the Winner within 7 days of their selection as the Winner or are unable to agree a suitable method of payment for the contest fund to the Winner We will be entitled to disqualify the Winner from the relevant contest and select the next qualifying user.
We are not under any obligation to make payment of the Contest Fund to any person with a verifiable name other than that provided at Registration, although We may choose to do so at Our sole discretion. In the event that You are selected as the Winner You are found to hold multiple Accounts and/or the name You provided at Registration is not Your verifiable real name or You fail to provide Us with photo identification and proof of Your identity and/or address and/or You fail to provide Us with evidence of any change to the details You provided on Registration where requested within 7 days of being selected as the Winner We may elect to disqualify You from the relevant Contest of Indiasfuture and select the next Qualifying Winner in our records. We will not make payment of the Prize Fund to any person who is not a qualifying user.
The Winner for each Round will be published on the Website and, will be entitled to the Contest Fund. Any reasonable charges or costs of conversion related to the payment of the Prize Fund to the Winner will be met by the Winner.
At the end of the all contest or 1 years from the date of launch, which ever is earlier we will conduct a poll and select a charity to make a donation of at least 5% of our share of the revenue.
In the event that You are the Winner in any Contest You consent Indiasfuture the use of Your name and likeness for advertising purposes, including but not limited to Your name being announced on the Website, and to participate in publicity for Indiasfuture as reasonably instructed by Us.

Registration And Security Terms

Users should be 16 years of age or older or the minimum legal age in the country/province of residence or citizenship.
You should be aware and not reside in or be a citizen of any country/province in which it is unlawful for Us to provide you with access to the Website, facilities to click on Ads, make an Entry or win Contests.
Accounts may not be sold or transferred to anyone.
You shall ensure that the details provided at Registration are accurate and kept up to date. You can change the details You provide at Registration at any time by contacting support.
All information submitted at the time of registration should be verifiable.
You are prohibited from holding more than 1 (one) Account. We reserve the right to close Your Account(s) if You open multiple Accounts. Please note that We are under no obligation to make payment of the Referral Contest Prize to any person who is found to hold multiple Accounts.

Use of the Website

You may not use the Website in any way that may lead to the encouragement, procurement or carrying out of any criminal activity.
You may not use malpractices to win contests, and attempt to penetrate the Websites security measures.
We reserve the right to suspend, restrict or terminate Your access to this Website at any time without notice at Our discretion.

Information For Advertisers

Indiasfuture.com will make available one million pixels for hosting Advertisements for the duration of a minimum of 1 years, from the Date of Launch. The Pixels will be in a grid hosted on the Website (the "Grid"). The Pixels will be made available in blocks of one hundred (100) Pixels each (the "Advertising Spaces"). Each Advertising Space (“Block”)will measure ten Pixels by ten Pixels (10x10).
Each Block will be sold at one hundred US dollars (USD100).
The Advertiser may place Orders for Advertising Spaces subject to availability.
By placing an Order with Indiasfuture.com the Advertiser accepts and agrees to comply with the terms and conditions of the Contract.
Unless otherwise agreed between the parties, the Advertiser will provide all materials for the Advertisements in accordance with Indiasfuture.com's policies in effect from time to time, including without limitation such technical specifications and format guidelines as to content of Advertisements as Indiasfuture.com may specify from time to time.
Indiasfuture.com reserves the right at any time, in its sole discretion and without liability to the Advertiser, to reject or cancel any Advertisement or Order or remove any Advertisement from the Website. Any acceptance by Indiasfuture.com of an Advertisement shall not be deemed to constitute an acceptance by Indiasfuture.com that such Advertisement is provided in accordance with the Contract nor shall it constitute a waiver of Indiasfuture.com's rights.
Indiasfuture.com shall not be held responsible for any addition to, changes in, deletions from, delay in publication or withdrawal of any Advertisement required by any competent authority having jurisdiction over or responsibility for the regulation of electronic and online advertising on the Internet (including without limitation the ASA).
The content, layout and format of the Website shall be subject to variation at the sole discretion of Indiasfuture.com.
In the event of Indiasfuture.com's publication of the Website being restricted, curtailed or prevented by any Law or any other act or thing beyond Indiasfuture.com's control, Indiasfuture.com may at any time, notwithstanding anything contained in this Contract, forthwith terminate this Contract in whole or in part without prejudice to Indiasfuture.com's right to be paid by the Advertiser any monies due at the date of termination.
Indiasfuture.com shall use reasonable endeavours to give a minimum of four (4) weeks' notice in respect of any change to the rates and/or to this Contract, but reserves the right to make such changes at shorter notice.
The Advertiser may not resell, assign at law or in equity (including by way of a charge or declaration of trust), sub-license or deal in any other manner with this Contract or any rights under this Contract or sub-contract any or all of its obligations under it or purport to do any of the same. Any attempt to do any of the foregoing shall result in immediate termination of this Contract, and payment of any and all amounts due hereunder without liability to Indiasfuture.com and without prejudice to its other rights and remedies. Any purported assignment in breach of this clause shall confer no rights on the purported assignee.
Indiasfuture.com does not accept liability for any delay in delivery, loss or damage to Advertisement copy. Unless otherwise instructed in writing, Advertisement copy will be destroyed by Indiasfuture.com or its agents if not published for a period of three Months without further reference to the Advertiser.
Indiasfuture.com's maximum liability in respect of any loss or damage suffered by the Advertiser and arising out of or in connection with this Contract, whether in contract, tort (including negligence) or for breach of statutory duty or in any other way, shall not exceed the value of the sums paid by the Advertiser to Indiasfuture.com in relation to the Order or Orders pursuant to which the relevant loss or damage has arisen.
The Advertiser represents and warrants to Indiasfuture.com that it has or will have obtained prior to the publication of any Advertisement all necessary rights, consents, licences, clearances and waivers in relation to the relevant Advertisement to enable Indiasfuture.com to publish such Advertisement on the Website and the Advertiser shall be solely responsible for any and all payments due to third parties as a result of such publication.
Indiasfuture.com shall not be obliged to provide to the Advertiser with any data which might enable the Advertiser or any third party to identify any individual or individuals using or who have used the Website.
Indiasfuture.com shall have no liability for any delay in or failure to perform any or all of its obligations under this Contract if the delay or failure arises from or is attributable to acts, events, omissions or accidents beyond its reasonable control including, without limitation, industrial disputes, nuclear accident, war or terrorist activity, acts of God, civil commotion, compliance with any law, governmental order, rule, regulation, or direction, failure of technical facilities, accident, fire, flood, storm or default of suppliers or sub-contractors.
Nothing in this Contract shall create or be deemed to create a partnership, joint venture or principal-agent relationship between the parties and neither party shall have authority to bind the other in any way unless expressly provided otherwise in this Contract.

Your Legal Obligations

You agree to compensate Us for any claim or damages (including any legal fees in
relation to such claim or damages) made by a third party in respect of any matter in
relation to or arising from Your use of the Website including any breach or suspected
breach of these Terms or Your violation of any law or the rights of a third party.

Our Legal Obligations

We do not accept any liability for damage to Your computer system or loss of data that results from Your use of the Website and We cannot guarantee that any files that You download are free from viruses, contamination or destructive features.
Though We use all reasonable endeavors to correct any errors or omissions as soon as practicable once they have been brought to Our attention, We do not warrant that the information on the Website itself will be free from errors or omissions.
Access to the Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond Our control.
All content and services on the Website are provided on an 'as is' and 'as available' basis. We do not make any representation or give any warranty (whether express or implied) in respect of the Website or its content, including, without limitation, any advice given (on a personal or general basis) and statements made by advertisers on or via the Website.

Changes About these terms and conditions

We may amend these Terms at any time either by emailing You notification of the new Terms and/or by publishing the modified Terms on the relevant page of the Website. All such changes will take effect within thirty (1) days once they have been posted on the Website or emailed to You and You will be deemed to have accepted any such changes by Your use of the Website following such time.
